What Is The Process For Divorce In Marietta?

The contested divorce process officially begins when one spouse files a petition for divorce with the superior court in the county where they or the other spouse lives. The petition must state their grounds for divorce. The most common of the grounds given is “irreconcilable differences,” but you can also claim several other grounds, including adultery, fraud and willful desertion. You can make requests for temporary orders for child support, alimony and so on while your divorce is pending. You must also include personal information, such as your income and financial assets.

The filing spouse must also serve the other spouse with copies of the divorce papers. Once they are served, the spouse has 30 days to respond with their own personal information and temporary order requests. The judge will then consider each party’s requests and issue rulings.

At this point, you and your spouse will try to negotiate a settlement that includes key matters like division of assets and child custody. In Cobb County, the judge will require you to attend divorce mediation. If an out-of-court settlement is not possible after reasonable efforts, then the court will hold a trial to settle the remaining differences. Cobb County also requires divorcing parents to attend a seminar on co-parenting post-divorce before their divorce is finalized.

An uncontested divorce is a shorter process. It works by having the spouses settle all key matters and signing a settlement agreement before filing for divorce.

Common Questions About Cobb County Divorce

Does it matter who files first in Georgia?

Not really. The spouse who did not file will get the chance to file a counterclaim that accomplishes the same thing as the initial filing.

How long does the divorce process take in Cobb County?

State law requires a 30-day waiting period between filing for divorce and finalizing proceedings. However, most contested divorces take longer to resolve – generally, several months. An especially contentious divorce that requires a trial could take a year or more. An uncontested divorce generally takes less time.

What are the grounds for divorce in Georgia?

The most common of the grounds given for divorce is irreconcilable differences, also known as no-fault divorce. The other grounds available under Georgia law are:

  • Consanguinity, or the parties being too closely related
  • Mental incapacity at the time the marriage began
  • Sexual impotence
  • One spouse obtained the marriage through force, fraud, duress or menace
  • The wife was pregnant at the time of marriage by someone other than the husband, unbeknownst to the husband
  • Adultery
  • Willful and continued desertion for at least one year
  • A conviction for a crime of moral turpitude, for which the spouse is sentenced for at least two years in prison
  • Habitual intoxication
  • Cruelty, or the infliction of mental or physical pain to the other spouse that they reasonably believed put their life, limb or health in danger
  • Incurable mental illness, as adjudged by a court or by two physicians. The mentally ill spouse must have been confined to a mental health facility or under continuous care for at least two years
  • Habitual drug addiction

Next, take exit 263 for GA 120 W toward Marietta/KSU Campus. Keep right and merge onto GA-120/South Marietta Parkway SE. Turn left onto Franklin Gateway SE and then turn left onto Parkway Place. Follow the road and The Siemon Law Firm will be on the right.
